Rental Instruction

This page provides a general overview of Chery Equipment’s equipment rental process and requirements. Equipment availability, rental rates, deposits, transportation charges, insurance requirements, and other terms may vary depending on the Equipment, rental period, Customer location, and Job Site conditions.

The final terms of each rental are governed by the quotation, signed rental agreement, and other applicable written documents. This page is provided for general informational purposes only. It does not constitute a rental agreement or expand, modify, or replace any provision of a signed agreement.

1. Rental Periods and Equipment Availability

This page primarily describes Chery Equipment’s monthly rental program. Rental rates and general terms displayed on the website are primarily intended for monthly rentals.

Customers requiring a daily or weekly rental should contact Chery Equipment to discuss Equipment availability, pricing, minimum rental periods, transportation charges, and other applicable conditions. Daily and weekly rentals may not be available for all Equipment and are subject to a separate written agreement.

Rental availability is determined by the description displayed on the applicable Equipment page:

  • Equipment clearly marked “Rent,” or with similar rental language may be submitted for a rental request;

  • Equipment that does not display a rental designation is available for sale only and is not offered for rent;

  • Pallet Jacks are currently available for sale only and are not offered for rent;

  • The rental availability of Stackers and other Equipment depends on the applicable product listing, current inventory, and final confirmation from Chery Equipment; and

  • Rental rates, insurance requirements, transportation arrangements, and service availability for heavy construction equipment must be separately confirmed.

Submission of a rental request does not reserve the Equipment or constitute approval of the rental. Equipment availability, rental duration, pricing, deposit, and other terms are subject to final confirmation and a signed rental agreement.

2. Rental Process

The rental process generally includes the following steps:

    1. The Customer submits a rental request and Equipment requirements;

    2. Chery Equipment confirms availability, rental duration, pricing, and transportation arrangements;

    3. The Customer provides the required company, Job Site, payment, and insurance information;

    4. The parties review and sign the rental agreement;

    5. The Customer pays the first rental payment, security deposit, and other amounts due before delivery;

    6. The Equipment is made available for pickup by the Customer or the Customer’s authorized carrier. At the Customer’s request, Chery Equipment may assist in arranging third-party transportation. All delivery, pickup, freight, loading, unloading, permits, and related transportation charges are separate from the rental rate and are the Customer’s responsibility; and

    7.  At the end of the rental, the Equipment is returned, inspected, and subject to final account settlement.

The rental will not be considered confirmed until the required agreement has been signed, the required documents have been approved, and all amounts due before delivery have been paid.

3. Rental Charges and Payment

Monthly rent is generally payable in advance without deduction or setoff.

In addition to the monthly rental charge, the Customer may be responsible for:

  • Applicable sales tax and other taxes;

  • Security deposit;

  • Delivery and pickup charges;

  • Insurance or equipment protection fees;

  • Fuel, charging, cleaning, and routine maintenance charges;

  • Standby, waiting-time, or remobilization charges caused by an unprepared Job Site;

  • Damage, repair, loss, or late-return charges; and

  • Other amounts identified in the quotation or rental agreement.

Rental rates, payment dates, deposits, included operating hours, and additional charges are governed by the applicable quotation and signed rental agreement.

Amounts more than five days late may accrue interest at 1.5% per month or the maximum lawful rate, whichever is lower, together with reasonable collection costs where permitted by law.

4. Security Deposit

The Customer must pay the security deposit stated in the rental agreement before delivery or pickup.

The security deposit may be applied to:

  • Unpaid rent or other charges;

  • Equipment damage or missing items;

  • Cleaning, fuel, or charging costs;

  • Pickup, transportation, or recovery expenses; and

  • Other amounts due under the rental agreement.

After the Equipment has been returned, inspected, and the Customer’s account has been finalized, any remaining deposit balance will be returned according to the timeframe stated in the rental agreement.

5. Insurance and Certificate of Insurance

The Customer must provide a valid Certificate of Insurance (“COI”) that satisfies the requirements of the applicable rental agreement and is approved by Chery Equipment before the Equipment is shipped or delivered.

If the Customer does not provide an approved COI before shipment or delivery, the following insurance fee will apply:

  • Forklifts: $215 per unit per month;

  • Construction equipment: 15% of the applicable monthly rental charge.

Submission of a COI does not automatically mean that the Customer’s insurance has been approved. Coverage types, policy limits, additional-insured status, loss-payee status, and all other requirements must comply with the applicable rental agreement and be approved by Chery Equipment.

A sample of an acceptable COI may be viewed or downloaded from this website and provided to the Customer’s insurance agent for reference. The sample is provided for guidance only and does not replace the requirements of the applicable rental agreement.

If the Customer provides an approved COI after the rental has started, any discontinuation of the insurance fee and its effective date must be confirmed by Chery Equipment in writing. Unless otherwise agreed in writing, insurance fees already incurred will not be retroactively waived or refunded.

The applicable fee is charged when the Customer does not provide an approved COI. It is not a fee for purchasing, applying for, or issuing a Certificate of Insurance.

6. Delivery and Job Site Readiness

Before delivery, the Customer must provide safe, legal, and unobstructed access to the Job Site.

The Customer is responsible for ensuring that the Job Site has:

  • Stable ground capable of supporting the Equipment and delivery vehicle;

  • Adequate unloading and operating space;

  • Required permits and traffic-control arrangements;

  • Necessary unloading personnel, if applicable;

  • Clearly identified underground utilities and other hazards; and

  • Road and entrance conditions suitable for safe delivery and pickup.

The Customer may be responsible for reasonable standby, waiting-time, remobilization, additional transportation, or labor charges caused by an inaccessible or unprepared Job Site.

7. Equipment Inspection and Acceptance

The Customer must inspect the Equipment at the time of delivery or pickup.

Any material defect, damage, or nonconformity should be reported to Chery Equipment in writing within the inspection period stated in the rental agreement. The Customer should provide photographs, videos, fault codes, and other supporting information when available.

Continued use of the Equipment after the applicable inspection period generally constitutes acceptance of its delivered condition. However, this does not waive a valid claim involving a latent defect that could not reasonably have been discovered during the initial inspection.

8. Equipment Use

Only properly trained and authorized operators may use the Equipment.

The Customer must:

  • Follow the manufacturer’s operating instructions, rated capacity, and safety requirements;

  • Comply with OSHA requirements and all other applicable laws;

  • Use the Equipment only at the Job Site identified in the rental agreement;

  • Not move the Equipment to another location without prior written approval;

  • Not sublease, lend, or permit unauthorized third-party use of the Equipment;

  • Not remove or interfere with identification labels, GPS devices, telematics systems, or hour meters;

  • Not modify, disassemble, or repair the Equipment without prior written authorization; and

  • Immediately stop using unsafe or malfunctioning Equipment and notify Chery Equipment.

The Customer is responsible for its employees, contractors, invitees, and any person who operates, possesses, or transports the Equipment with the Customer’s permission.

9. Maintenance and Repairs

During the rental period, the Customer must keep the Equipment clean and in good operating condition, ordinary wear and tear excepted.

The Customer is responsible for:

  • Routine inspections;

  • Proper lubrication;

  • Charging or fueling;

  • Checking and maintaining required fluid levels;

  • Following the manufacturer’s maintenance instructions; and

  • Maintaining accurate service and operating-hour records.

No third party may repair, disassemble, modify, or replace parts without Chery Equipment’s prior written authorization, except for reasonable emergency measures necessary to prevent personal injury or further material damage.

The Customer may be responsible for damage and costs resulting from unauthorized repairs, improper maintenance, incorrect fuel or fluids, misuse, overloading, negligence, or continued operation after a warning or malfunction.

10. Equipment Malfunction and Service Request

If the Equipment experiences a malfunction and continued operation could create a safety risk or cause further damage, the Customer must immediately stop using the Equipment and complete the Equipment Service Request Form as soon as possible.

The Customer should provide:

  • Equipment make and model;

  • Serial number;

  • Current operating hours;

  • Equipment location;

  • A detailed description of the issue;

  • Fault or error codes, if applicable;

  • Supporting photographs or videos; and

  • Relevant maintenance and service records.

The Equipment must be made reasonably available for inspection and diagnosis.

Depending on the cause of the issue, the Customer’s location, Equipment availability, and the applicable rental agreement, Chery Equipment may arrange for inspection, repair, replacement Equipment, or a rental adjustment for the affected period.

If the issue resulted from misuse, overloading, accident, negligence, unauthorized repair, or failure to properly operate or maintain the Equipment, the related repair, transportation, labor, and other costs may be charged to the Customer.

11. Loss, Theft, and Damage

From delivery or Customer pickup until the Equipment has been returned and accepted by Chery Equipment, the Customer bears the risk of theft, disappearance, vandalism, misuse, accident, fire, weather-related events, and other loss or damage, except to the extent otherwise stated in the signed rental agreement.

The Customer must promptly report any accident, theft, disappearance, or material damage and cooperate with Chery Equipment, the applicable insurance companies, and law-enforcement authorities.

For repairable damage, the Customer may be responsible for reasonable costs associated with:

  • Inspection and diagnosis;

  • Parts and labor;

  • Transportation and recovery;

  • Cleaning;

  • Diminished value; and

  • Loss of rental income during the repair period.

For theft, disappearance, or total loss, the Customer may be responsible for the Equipment’s fair replacement value immediately before the loss, unpaid rent, and reasonable recovery costs, less applicable insurance proceeds actually received by Chery Equipment, without double recovery.

Payment of an insurance or equipment protection fee does not eliminate all Customer responsibility. Coverage remains subject to the applicable rental agreement, exclusions, deductibles, claim requirements, and other stated conditions.

12. Equipment Return

At the end of the rental period or upon earlier termination, the Customer must stop using the Equipment and return it at the time and location stated in the rental agreement.

The Equipment must be returned:

  • In substantially the same condition as received, ordinary wear and tear excepted;

  • Reasonably clean;

  • Fully fueled or charged, as required;

  • With all keys, manuals, attachments, accessories, and records; and

  • Free from unauthorized modifications or repairs.

The Customer remains responsible for the Equipment until it has been inspected and accepted as returned by Chery Equipment.

13. Late Return and Holdover

The Customer may not retain or continue using the Equipment after the end of the rental period without Chery Equipment’s prior written approval.

A late return does not automatically extend or renew the original rental term. The Customer may be charged daily holdover rent calculated at 1/30 of the applicable monthly rent for each day the Equipment is retained, together with reasonable retrieval, transportation, and related costs.

14. Rental Cancellation

If the Customer cancels the rental within five calendar days before the scheduled start date, Chery Equipment may charge a reasonable cancellation or restocking fee of up to 20% of the scheduled rent, based on Equipment reservation, preparation, and transportation arrangements already made.

The security deposit may be applied to the cancellation fee. Final cancellation terms are governed by the applicable quotation and signed rental agreement.

15. Agreement Controls

This page is a general summary only. Equipment availability, rental rates, deposits, included operating hours, insurance requirements, transportation charges, cancellation fees, maintenance obligations, and all other rental conditions are governed by the final quotation and signed rental agreement.

If this page conflicts with the signed rental agreement, the signed rental agreement will control.

Statements made by sales representatives, technicians, drivers, or other personnel—whether verbally, by text message, or by email—do not expand or modify the rental terms unless confirmed in writing by an authorized representative of Chery Equipment.
